What is CAE and how does it help homeowners’ associations?
CAE prevents occupational risks for employees from different companies working at the same site. It does this through strict document control. The Supreme Court ruling STS 2190/2022 recognizes homeowners’ associations as economic entities with responsibilities when outsourcing services. This means that the community assumes joint liability for contractors and subcontractors in case of infractions or claims.
Is CAE mandatory? When and why?
Whenever multiple companies operate on a property, the community is obligated to report occupational risks and implement preventive and emergency measures.
This requirement is backed by the Occupational Risk Prevention Law (LPRL) and Article 42 of the Workers’ Statute. Even without a formal staff, CAE is necessary to ensure worker safety on the premises.
Legal Responsibility of the Association and Its President
Homeowners’ associations may face administrative and criminal penalties for non-compliance with occupational safety regulations. Fines can range from €2,045 to €820,000, depending on severity. In extreme cases, prison sentences of up to three years may apply.
