FAQ - Health & Safety

As a self-employed person, am I required to have occupational health and safety cover?

Self-employed workers without employees must have the necessary occupational health and safety documentation relating to the work they carry out at the client’s premises, in accordance with the regulations on the Business Activities Coordination (BAC). This documentation comprises:

  • Occupational Risk Assessment: this is the means of providing written information on the risks associated with their work.
  • Job-specific training in accordance with Article 19 of Law 31/95 on Occupational Risk Prevention.
  • Record of the handover of Personal Protective Equipment (PPE).

Self-employed workers with employees are no longer considered self-employed but are classified as a business. They must therefore comply with the same legal requirements regarding occupational risk prevention as any other business.

Occupational Health & Safety in English

There is currently an increasing need for documentation to be produced in English due to the presence of companies from Europe and the rest of the world.

This is also driven by the exchange of documents for the purposes of coordinating business activities. Such documentation includes Occupational Risk Assessments, Training Certificates and Medical Certificates, Emergency Plans, etc.

At Geseme, we are fully equipped to meet this need and have a team of senior technicians and trainers with native-level proficiency in English and other languages, ensuring that this is not a barrier for any company.

Questions regarding the Occupational Health and Safety Act

Currently, all business activities relating to the prevention of risks and the protection of workers are governed by Law 31/95 on Occupational Risk Prevention.

Similarly, there is a wide range of legislation covering specific aspects of occupational risk prevention, such as:

  • Royal Decree 171/2004 on the COORDINATION OF BUSINESS ACTIVITIES.
  • Royal Decree 486/97 on WORKPLACES
  • Royal Decree 1215/97 on WORK EQUIPMENT.
  • Royal Decree 286/2006 on risks arising from EXPOSURE TO NOISE.
  • Royal Decree 773/1997 on the use of PERSONAL PROTECTIVE EQUIPMENT.
